 Seit Januar 2007 sind neuartige Rundfunkempfangsgeraete rundfunkgebuehrenpflichtig. Neben Computern fallen auch weitere internetfaehige Geraete in diese Geraetekategorie.

m Gegensatz zu Radio- oder Fernsehgeraeten, deren primaerer Zweck der Rundfunkempfang ist, werden diese Geraete normalerweise fuer andere Zwecke verwendet. Desweiteren sind sie, im Gegensatz zu Radio und TV, im normalen (Geschaefts-)Leben unverzichtbar geworden. Teilweise ist ihre Benutzung sogar von staatlicher Seite vorgegeben (z.B. Umsatzsteuervoranmeldung).

Auf welchen rechtlichen Grundlagen die Erhebung geschieht und welche Folgen das haben kann, ist auf den folgenden Seiten nachzulesen.
 

 Seit dem 1. Januar 2007 sind fuer Personal Computer die Rundfunkgebuehren zu entrichten. Die Oeffentlich-Rechtlichen Rundfunkanstalten handeln hier strickt nach dem Rundfunkgebuehrenstaatsvertrag, welcher die Gebuehr für die PCs festlegt.

Der Gesetzgeber hat es bis heute jedoch versaeumt, die rechtlichen Voraussetzungen dafuer zu schaffen, damit diese Gebuehr mit den Grundgesetzen konform ist.

Auf dieser Webseite ist meine Klage gegen die Erhebung von Rundfunkgebuehren auf einen gewerblich genutzten Personal Computer dokumentiert.
